1. Parties
1.1 The “Seller” refers to Turkmen Art Jewellery as identified above.
1.2 The “Consumer” refers to the natural person placing an order on the Seller’s website for purposes outside their trade, business, or profession.
2. Subject of the Agreement
2.1 The Seller undertakes to supply the goods (“Goods”) ordered by the Consumer, and the Consumer undertakes to pay for and accept delivery of those Goods under the terms of this Agreement.
2.2 The Consumer confirms that all pre-contractual information required under applicable consumer protection laws has been clearly provided and understood prior to placing the order.
3. Order and Contract Conclusion
3.1 A binding contract is concluded when the Consumer clicks the “Order & Pay” button (or equivalent) and receives an electronic order confirmation from the Seller.
3.2 Before finalizing the order, the Consumer is informed of:
– the Seller’s identity and contact details,
– the main characteristics of the Goods,
– the total price including all taxes and delivery costs,
– payment and delivery terms, and
– the 14-day right of withdrawal and related procedures.
4. Price and Payment
4.1 All prices displayed on the website are final prices in EUR, including applicable taxes and standard shipping charges unless otherwise stated.
4.2 Payment must be completed at the time of order using the secure payment methods provided on the website.
4.3 In the event of non-payment or failed transaction, the Seller reserves the right to suspend or cancel delivery.
5. Delivery
5.1 The Goods are shipped from Turkey and delivered to the address provided by the Consumer. Delivery shall take place within a maximum of 30 days unless otherwise agreed.
5.2 Risk of loss or damage transfers to the Consumer once the Goods are delivered and physically received by the Consumer or an authorized third party.
5.3 International orders may be subject to customs duties or import taxes, which are the sole responsibility of the Consumer.
6. Right of Withdrawal (Cancellation)
6.1 The Consumer has the right to withdraw from this Agreement within 14 calendar days from the date the Goods are received, without giving any reason.
6.2 To exercise this right, the Consumer must notify the Seller via email (turkmendogaltas@gmail.com) or other written communication before the withdrawal period expires.
6.3 Returned Goods must be sent back in their original condition and packaging within 14 days of notifying the Seller.
6.4 The Consumer bears the direct cost of return shipping unless the Seller has agreed otherwise.
6.5 The Seller will refund all payments received (excluding any express shipping chosen by the Consumer) within 14 days of being informed of the withdrawal, using the same payment method originally used by the Consumer.
6.6 The right of withdrawal does not apply to:
– custom-made or personalized products,
– unsealed goods that cannot be returned for hygiene reasons,
– goods that have been worn, altered, or damaged after delivery.
7. Consumer Obligations
7.1 The Consumer must handle the Goods with due care and only to the extent necessary to determine their characteristics and functioning.
7.2 Any loss in value due to unnecessary handling may be deducted from the refund amount.
8. Seller’s Liability and Warranty
8.1 The Seller guarantees that the Goods correspond to the description and quality stated on the website.
8.2 All products are checked before shipment. Minor natural variations in gemstones are not considered defects.
8.3 Statutory warranty rights apply for a period of 2 years from delivery unless a longer period is required by the Consumer’s local law.
9. Complaints and Dispute Resolution

9.2 For cross-border disputes within the European Union, Consumers may seek assistance through the European Consumer Centres Network (ECC-Net) or another authorized alternative dispute resolution platform.
10. Governing Law and Jurisdiction
10.1 This Agreement is governed by the laws of the Republic of Turkey, except where mandatory consumer protection laws of the Consumer’s country of residence prevail.
10.2 Any disputes arising under or in connection with this Agreement shall be subject to the competent courts of Istanbul, Turkey, without prejudice to the mandatory rights of the Consumer to bring claims in their home jurisdiction.
11. Miscellaneous
11.1 Amendments or modifications to this Agreement must be in writing and agreed by both parties.
11.2 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain valid and binding.
11.3 The Seller reserves the right to update or revise this Agreement where required by law; such changes will not affect prior orders already concluded.
12. Confirmation
12.1 The Seller shall send a copy of this Agreement together with the order confirmation to the Consumer by email.
12.2 By clicking “Order & Pay”, the Consumer confirms that they have read, understood, and accepted the terms of this Agreement.
